806 - Possession of a Firearm in a Restricted Area

806 (a) - Any property owner, or responsible appointee of one, may prohibit the possession of firearms by other civilians on their property (including homes, businesses, etc.).

Any property owner, or responsible appointee of one (including security personnel), may conduct searches of persons entering, or persons within, their property for the purpose of detecting weapons which they have prohibited. This principle also applies to law enforcement conducting searches of persons entering, or persons within, secured areas where firearms are prohibited, such as a courthouse.

806 (b) - No person shall be found to be in possession of a firearm, weapon, or explosive, regardless of past criminal record or license to carry, while within the property of:

  • Hospitals

  • Medical Clinics

  • Police Stations and Sheriff's Offices

  • Jails and Prisons

  • Schools, Colleges, and Universities

  • Libraries

  • Court Houses

  • City Hall

  • Airports

  • Banks

Misdemeanor

Sentence: 500 Seconds

Fine: $500

This offence is a wobbler charge. This means that it may be either a Federal Charge or a Regular Charge depending on the nature of the victim.
