F3-04 - Deportation and Entry Refusal Authority

This code provides the Department of Homeland Security (DHS) the authority to turn away persons whom are attempting to pass through a port of entry without ANY of the following:

  • Providing proof of United States Citizenship or Residency

  • Providing proof of a Visa

  • Providing proof of an attempt to, or attempting to, apply for a Visa or Asylum request

Additionally, this code gives DHS the authority to deport any persons that are already within or attempting to gain entry to the United States.

This is processed differently than a normal arrest as the individual's name, DOB, and general information is logged and then the individual is turned back to their originating country.
